TERMS AND CONDITIONS: 100% PLACEMENT GUARANTEE SCHEME

These Terms and Conditions (“T&Cs”) govern the 100% Placement Guarantee Scheme (“Scheme”) offered by VLCC Limited (formerly known as VLCC Health Care Limited ) (“VLCC” or “Company”) to students enrolled in designated professional training programs at its training centres across India. By enrolling in an eligible course and opting for this Scheme, the student (“Student”) agrees to be bound by the terms set forth herein:

1. THE SCHEME

  • Providing real-time on the job training and skill development thereby making eligible students eligible of being considered for a placement (internship or employment) following successful completion of their designated offline course and such other terms and conditions as may be prescribed. The scheme shall only to be considered as a skill development and facilitation mechanism and not an offer, assurance or contract of employment by VLCC.

2. APPLICABILITY & SCOPE

  • 2.1 The Scheme is applicable exclusively to offline, in-centre courses offered at VLCC School of Beauty training institutes .
  • 2.2 The Scheme is available only for specific courses notified by VLCC from time to time. A list of such courses shall be available at the time of enrolment.
  • 2.3 The scheme is applicable to a student who meets the minimum age criteria of 18 years at the time of enrolment and is legally eligible to work in the country.
  • 2.4 The Scheme shall not apply to online, hybrid, self-paced programs or any other programme offered by VLCC by any other name whatsoever.

3. ELIGIBILITY CRITERIA

  • 3.1 To qualify for the 100% Placement Guarantee under this Scheme, the Student must:
    • a. Provide valid documents, including identification, academic records, and any other documents requested by VLCC or the placement partner/3rd party placement company.
    • b. Maintain a minimum of 90% attendance throughout the course duration;
    • c. Obtain a minimum final grade of A+, A, B+, B upon successful evaluation (as per VLCC’s internal grading system, wherein the student shall be required to undergo both theory exam conducted online on the blended learning applications with pre defined MCQ as per the course and practical examination evaluated and assessed by an external assessor);
    • d. Successfully clear all theoretical and practical examinations, including any internal assessments or practical , as may be prescribed by VLCC during the course tenure and no extension shall be provided for completion of the same;
    • e. Adhere to VLCC’s Code of Conduct throughout the duration of the course;
    • f. Adhere to such other terms and conditions as may be stipulated and prescribed by VLCC from time to time.
  • 3.2 Students failing to meet any of the above criteria will not be eligible for placement under this Scheme. No exceptions shall be entertained. VLCC reserves the right to independently verify eligibility and to disqualify any Student failing to meet the criteria as per its sole discretion.
  • 3.3 To be eligible for 100% Placement Guarantee under the Scheme, the Student must have successfully completed a minimum of 10+2 ( Class 12 ) education from a recognized board or institution in India . In case the student who enrols in any of the notified shortlisted Courses but has not completed Class12, such Student shall not be eligible for the Placement Guarantee, but may be extended placement assistance at the sole discretion of VLCC . The nature, scope, and extent of such assistance shall not amount to or be construed as a guarantee or assurance of employment or internship.

4. NATURE AND DURATION OF PLACEMENT

  • 4.1 Subject to meeting the eligibility conditions, VLCC shall facilitate placement opportunities for the eligible Students within __6months from the date of successful course completion.
  • 4.2 The placement may be offered:
    • a. At VLCC, or
    • b. At any third-party partner salon/brand/company.
  • 4.3 The decision regarding placement location, employer, and role shall be at the sole discretion of VLCC, based on availability and business requirements and students shall have no discretion regarding the same.
  • 4.4 VLCC does not guarantee placement in any specific city, brand, or position. Students may be placed in any part of India and are expected to relocate at their own cost if required.
  • 4.5 Obligation of VLCC under this Scheme shall be limited to facilitating the placement; VLCC shall not be responsible for continued employment, working conditions, or terms of engagement post-placement.
  • 4.6 VLCC shall not be liable to pay any travel or accommodation allowance or any other type of charge/expense for facilitating such interview and the same shall be solely borne by the candidate only.
  • 4.7 Any full time employment or internship with a pre-placement offer that a student gets in a profile directly related to the course availed for 100% placement guarantee scheme, through own effort or any other medium shall be considered job guarantee fulfilled.
  • 4.8 For the purpose of this Scheme, a placement shall be deemed successful upon issuance of an employment or internship offer by the Placement Provider, regardless of subsequent acceptance by the Student.

5. PLACEMENT STRUCTURE AND COMPENSATION

  • 5.1 Placements offered under the Scheme shall be in one of the following forms:
    • a. Employment-based.
    • b. Any other nature of placement as may be desirable or deemed appropriate as per the hiring partner.
  • 5.2 During the placement tenure, the student shall be entitled to a stipend or salary not less than Rs. 15000 per month (exact amount and nature to be disclosed at the time of placement offer subject to offer details provided by the Placement Provider)
  • 5.3 The terms of employment or internship, including duration, compensation, responsibilities, and any benefits, shall be governed solely by the agreement between the student and the placement provider. VLCC shall not be liable for any disputes arising therefrom.

6. STUDENT RESPONSIBILITIES

  • 6.1 At the time of enrolment, the Student must:
    • a. Opt into the Scheme in writing;
    • b. Indicate preferred placement requirements, if any (VLCC shall consider these preferences on a best-effort basis and does not guarantee adherence);
    • c. Agree to be bound by the T&Cs and sign a declaration to this effect.
  • 6.2 The Student shall:
    • a. Make sincere and reasonable effort to attend interviews for successful placement processes as directed;
    • b. Accept the placement offers provided if it meets the Scheme’s minimum standards, failing which the student shall be deemed to have voluntarily withdrawn;
    • c. Not reject any reasonable placement opportunity without valid cause;
    • d. Provide timely responses to communications from VLCC or placement partners.
  • 6.3 Failure to cooperate in the placement process or unreasonable rejection of offers shall amount to voluntary withdrawal from the Scheme.
  • 6.4 The Student shall not engage in any conduct that undermines the integrity of the placement process, including misrepresentation or refusal to appear for scheduled interviews without valid cause.

7. EXCLUSIONS AND LIMITATIONS

  • 7.1 VLCC does not guarantee permanent employment or employment in a specific brand, location, or salary range.
  • 7.2 VLCC shall not be liable for:
    • a. The conduct, practices, or policies of the placement provider;
    • b. Any employment-related disputes between the Student and the Employer;
    • c. Damages, claims, or losses arising post-placement.
  • 7.3 VLCC shall not be liable or responsible for students who:
    • a. Fail to meet eligibility criteria;
    • b. Voluntarily withdraw from the Scheme;
    • c. Reject a valid placement offer;
    • d. Are terminated by the employer after placement;
    • e. Are unable or unwilling to relocate or join on the assigned date.
  • 7.4 VLCC shall refund the course enrolment fee excluding taxes , administrative fees, and non-refundable charges in the event VLCC fails to facilitate any placement opportunity within the prescribed timeline, despite the Student meeting all eligibility criteria. Such refund shall be subject to internal verification and approval by VLCC.

8. TERMINATION AND DISQUALIFICATION

  • 8.1 VLCC reserves the right to disqualify a Student from the Scheme, with or without notice and without any refund on grounds including but not limited to:
    • a. Misconduct or indiscipline;
    • b. Academic dishonesty;
    • c. Non-cooperation or failure to complete the program
    • d. Breach of attendance or exam obligations;
    • e. Submission of false or misleading information;
    • f. Legal non-compliance or criminal activity.
    • g. Failure to pay the course fee prescribed by VLCC within the time period stipulated by VLCC.
    • h. Such other reason(s) as VLCC may deem fit.
  • 8.2 Disqualification shall be final and binding and no placement shall be provided in such cases.

9. GOVERNING LAW AND JURISDICTION

  • 9.1 These T&Cs shall be governed by and construed in accordance with the laws of India.
  • 9.2 Any disputes arising out of or in connection with the Scheme shall be subject to the exclusive jurisdiction of the competent courts at New Delhi.

10. MISCELLANEOUS

  • 10.1 These Terms constitute the entire understanding between VLCC and the Student concerning the Scheme and supersede any prior oral or written representations, understandings, or communications, including marketing materials or verbal assurances by agents or staff.
  • 10.2 Nothing in these Terms shall be construed to create any employer-employee, partnership, agency, or joint venture relationship between the Student and VLCC.
  • 10.3 No third party shall have any rights under these Terms. These Terms are personal to the Student and are not assignable or transferable.
  • 10.4 VLCC shall not be held liable for any delay or failure in performance of its obligations under this Scheme if such delay or failure results from events beyond VLCC’s reasonable control, including but not limited to natural disasters, strikes, lockouts, pandemics, regulatory changes, or disruption of operations.
  • 10.5 Failure or delay by VLCC in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy. Any waiver must be in writing and signed by an authorized representative of VLCC.
  • 10.6 If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.
  • 10.7 These Terms and Conditions have been drafted in English. In case of translation into any other language, the English version shall prevail in the event of conflict or inconsistency.
  • 10.8 Any relaxation or benefit granted by VLCC in deviation from these Terms shall be at its sole discretion and shall not constitute a precedent or waiver.
  • 10.9 Any notice required to be given under these Terms shall be deemed validly given if sent by registered post or email to the last known address or email ID of the Student.
  • 10.10 VLCC reserves the right to amend these Terms and Conditions at any time. The most updated version shall be available at the official VLCC premises or website. Continued participation shall imply acceptance of the revised terms.

PREAMBLE

This Code of Conduct ( ‘Code’ ) outlines the behavioural expectations and standard procedures and practices of the VLCC School of Beauty (hereinafter referred to as the ‘institute’) for all students enrolling with the Institute for pursuing various courses.

All students must know that it is incumbent upon them to abide by this Code of Ethics and Conduct (hereinafter referred to as the ‘Code’) and the rights, responsibilities including the restrictions mentioned in it.

Institute’s endeavour by means of enforcing this Code is to pioneer and administer a student discipline process that is equal, conscientious, effectual and prompt; and providing a system which promotes student growth through individual and collective responsibility.

All Students are requested to be well conversant with this Code, which can be also reviewed on the official website of the Institute.

JURISDICTION

Institute shall have the jurisdiction over the conduct of the students enrolled with the Institute and to take cognisance of all acts of misconduct including incidents of ragging or otherwise which are reported on the Institute premises or in connection with the Institute related activities and functions.

Institute may also exercise jurisdiction over conduct which occurs out of premises violating the ideal student conduct and discipline as laid down in this Policy and other regulations, as if the conduct has occurred within the premises which shall include:

  • a) Any violations of the Sexual Harassment Policy of the Institute against other students at the Institute.
  • b) Physical assault, threats of violence, or conduct that threatens the health or safety of any person including other students at the Institute.
  • c) Possession or use of weapons, explosives, or destructive devices within and outside institute premise.
  • d) Manufacture, sale, or distribution of prohibited drugs, alcohol etc.
  • e) Conduct which has a negative impact or constitutes a nuisance to members of the surrounding community.
  • f) Cyberbullying or misuse of digital platforms that affect the reputation or operations of the Institute

Institute, while determining the issue whether or not to exercise the code within/ outside jurisdiction in situations enumerated hereinabove, the Institute shall consider the seriousness of the alleged offense, the risk of harm involved, whether the victim(s) are students or community outside premise. The Institute reserves the right to initiate action based on complaints received from third parties, including the general public, employers, or law enforcement.

ETHICS AND CONDUCT

This Code shall apply to all kinds of conduct of students that occurs on the Institute premises, VLCC sponsored activities, functions in which VLCC participates on and off premises that has or may have serious consequences or adverse impact on the Institute’s Interests or reputation.

At the time of admission, each student must sign a statement accepting this Code and by giving an undertaking that

  • a) he/she shall be regular and must complete his/her studies in the Institute.
  • b) In the event, a student is forced to discontinue studies for any legitimate reason, such a student may be relieved from the Institute subject to written consent of the Business Head
  • c) As a result of such relieving, the student shall be required to clear pending dues and if a student had joined the Institute on a scholarship, the said grant shall be revoked.

Institute believes in promoting a safe and efficient climate by enforcing behavioural standards. All students must uphold academic integrity, respect all persons and their rights and property and safety of others.

All students must deter from indulging in any and all forms of misconduct including partaking in any activity off-premises which can affect the Institute’s interests and reputation substantially. The various forms of misconduct include:

  • a) Any act of discrimination (physical or verbal conduct) based on an individual’s gender, caste, race, religion or religious beliefs, colour, region, language, disability, or sexual orientation, marital or family status, physical or mental disability, gender identity, etc.
  • b) Intentionally damaging or destroying Institute property or property of other students and/or faculty members
  • c) Any disruptive activity in a classroom or in an event sponsored or participated by the Institute
  • d) Unable to produce the identity card, issued by the Institute, or refusing to produce it on demand by faculties or respective school team members.
  • e) Participating in activities including –
    • i. Organizing or participating meetings and processions without permission from the Institute.
    • ii. Engaging with or being affiliated with banned religious or terrorist groups as notified by the Institute/Government of India
    • iii. Unauthorized possession, carrying or use of any weapon, ammunition, explosives, or potential weapons, fireworks, contrary to law or policy.
    • iv. Unauthorized possession or use of harmful chemicals and banned drugs
    • v. Smoking is prohibited in and around the premises of the Institute
    • vi. Possessing, Consuming, distributing, selling of alcohol in and around the Institute
    • vii. Parking a vehicle in a no parking zone or in area earmarked for parking other type of vehicles
    • viii. Not disclosing a pre-existing health condition, either physical or psychological, to the VLCC SOB HOI during admission or later which may cause hindrance to the academic progress.
    • ix. Theft or unauthorized access to other resources
    • x. Misbehaviour during the classes and during any other activity of the Institute.
    • xi. Engaging in disorderly, lewd, or indecent conduct, including, but not limited to, creating unreasonable noise; pushing and shoving; inciting or participating in a riot or group disruption at the Institute.
  • f) Students are expected not to interact, on behalf of the Institute, with media representatives or invite media persons without the required approvals
  • g) Students are not permitted to either audio or video record lectures in classrooms or actions of other students, faculty, or staff without prior permission.
  • h) Students are not permitted to provide audio and video clippings of any activity on the campus to media without prior permission.
  • i) Students are expected to use the social media carefully and responsibly and shall refrain from posting, sharing, or circulating any content that is defamatory, abusive, misleading, or derogatory towards the Institute, its staff, or fellow students. Any such act shall attract disciplinary action.Theft or abuse of the Institute computers and other electronic resources such as computer and electronic communications facilities, systems, and services of Institute property or facilities, offices, classrooms, computer networks, and other restricted facilities and interference with the work of others is punishable. It also includes -
    • i. Damage to, or destruction of, any property of the Institute, or any property of others on the Institute premises.
    • ii. Making a video/audio recording, taking photographs, or streaming audio/video of any person in a location where the person has a reasonable expectation of privacy, without that person’s knowledge and express consent.
    • iii. Indulging in any form of Harassment which is defined as a conduct that is severe and objectively, a conduct that is motivated on the basis of a person’s race, colour, national or ethnic origin, citizenship, sex, religion, age, sexual orientation, gender, gender identity, marital status, ancestry, physical or mental disability, medical condition.

CORRECTIVE ACTION

If there is a case against a student for a possible breach of code of conduct, then a committee will be formed to recommend a suitable disciplinary action who shall inquire into the alleged violation and accordingly suggest the action to be taken against the said student. The committee may meet with the student to ascertain the misconduct and suggest one or more of the following disciplinary actions based on the nature of misconduct. The student shall be provided an opportunity to be heard before imposition of any major disciplinary action.

  • a) WARNING - Indicating that the action of the said delinquent student was in violation of the Code and any further acts of misconduct shall result in severe disciplinary action.
  • b) RESTRICTIONS - Reprimanding and Restricting access to various facilities in the institute for a specified period of time.
  • c) EXPULSION - Expulsion of a student from the Institute permanently. Indicating prohibition from entering the Institute premises or participating in any student related activities etc.
  • d) PLACEMENT GUARANTEE or ASSISTANCE will be withdrawn for such students.
  • e) MONETARY PENALTY - May also include suspension or forfeiture of scholarship/ fellowship for a specific time period.
  • f) SUSPENSION - A student may be suspended for a specified period of time which will entail prohibition on participating in student related activities, classes, programs etc.
  • g) DISMISSAL - Suspension, may also follow by possible dismissal, along with the additional penalties.
  • h) CONTINUATION OF COURSE - Ineligibility to reapply for admission to the Institute for a period of a year or more as decided by the VLCC SOB authorities.
  • i) Withholding the grade card or certificate for the courses studied or work carried out.

APPEAL

If the delinquent student is aggrieved by the imposition of any of the aforementioned penalties, he/she must appeal to the Director in writing within 7 days from the receipt of the disciplinary order. The Director may decide on one of the following:

Accept the recommendation of the committee and impose the punishment as suggested by the Committee or modify and impose any of the punishments as stipulated in this Code which is commensurate with the gravity of the proved misconduct.

Or

Refer the case back to the committee for reconsideration. The decision of the Director, after reviewing the appeal, shall be final and binding. No further representation or challenge shall be entertained..

ACADEMIC INTEGRITY

Academic Integrity encompasses honesty and responsibility and awareness relating to ethical standards for the conduct of research and scholarship. The Institute believes that in all academic work, the ideas and contributions of others must be appropriately acknowledged. Academic integrity is essential for the success of the Institute and its research missions, and hence, violations of academic integrity constitute a serious offence.

  • a) Scope and Purpose
    • i. This Policy on academic integrity, which forms an integral part of the Code, applies to all students at the Institute and are required to adhere to the said policy. The purpose of the Policy is two fold:
      • i To clarify the principles of academic integrity, and
      • ii To provide examples of dishonest conduct and violations of academic integrity.
    • ii. Failure to uphold these principles of academic integrity threatens both the reputation of VLCC SOB and the value of the degrees awarded to its students. Every member of the VLCC SOB community therefore bears a responsibility for ensuring that the highest standards of academic integrity are upheld.
    • iii. The principles of academic integrity require that a student,
      • i. Properly acknowledges and cites use of the ideas, results, material or words of others.
      • ii. Properly acknowledges all contributors to a given piece of work.
      • iii. Makes sure that all work submitted as his or her own in a course or other academic activity is produced without the aid of impermissible materials or impermissible collaboration.
      • iv. Obtains all data or results by ethical means and reports them accurately without suppressing any results inconsistent with his or her interpretation or conclusions.
      • v. Treats all other students in an ethical manner, respecting their integrity and right to pursue their educational goals without interference. This requires that a student neither facilitates academic dishonesty by others nor obstructs their academic progress.
  • b) Violations of this policy include, but are not limited to:
    • i. Plagiarism means the use of material, ideas, figures, code or data as one’s own, without appropriately acknowledging the original source. This may involve submission of material, verbatim or paraphrased, that is authored by another person or published earlier by oneself. Examples of plagiarism include:
      • i. Reproducing, in whole or part, text/sentences from a report, book, thesis, publication or the internet.
      • ii. Reproducing one’s own previously published data, illustrations, figures, images, or someone else’s data, etc.
      • iii. Taking material from class-notes or incorporating material from the internet graphs, drawings, photographs, diagrams, tables, spreadsheets, computer programs, or other non-textual material from other sources into one’s class reports, presentations, manuscripts, research papers or thesis without proper attribution.
      • iv. Self-plagiarism which constitutes copying verbatim from one's own earlier published work in a journal or conference proceedings without appropriate citations.
      • v. Submitting a purchased or downloaded term paper or other materials to satisfy a course requirement.
      • vi Paraphrasing or changing an author’s words or style without citation.
    • ii. Cheating includes, but is not limited to:
      • i. Copying during examinations, and copying of homework assignments, term papers, theses or manuscripts.
      • ii. Allowing or facilitating copying or writing a report or taking examination for someone else.
      • iii. Using unauthorized material, copying, collaborating when not authorized, and purchasing or borrowing papers or material from various sources.
      • iv. Fabricating (making up) or falsifying (manipulating) data and reporting them in thesis and publications.
      • v. Creating sources, or citations that do not exist
      • vi. Altering previously evaluated and re-submitting the work for re-evaluation
    • c) Signing another student’s name on an assignment, report or attendance sheet
    • d) Violations of academic integrity may result in denial of certificates, transcripts, or placement opportunities

SEXUAL HARRASSMENT

The Institute’s Policy on prevention and prohibition of sexual harassment at workplace, 2016 shall apply to the students of the Institute which can be accessed and reviewed by VLCC Ltd. Posh committee

Students should note that sexual misconduct or harassment encompasses a range of conduct, including but not limited to sexual assault, unwanted touching or persistent unwelcome comments, e-mails, or pictures of an insulting or degrading sexual nature, which may constitute harassment, which shall depend on the circumstances of each case.
